LEGAL AND DOCTRINARY ANALYSIS FOR THE INCORPORATION OF UNCAUSED DIVORCE IN THE LEGISLATION OF ECUADOR

The present research work is of vital importance since it originates in divorces, so it is necessary that in Ecuadorian legislation, to guarantee the right to free development of personality, privacy and family intimacy, and the right to family protection, the figure of uncaused divorce is regulated, and in this way those who intend to terminate the marriage bond do not have to invoke causes to be able to request it. In the substantive norm of Ecuador there are grounds to be able to divorce and terminate the marriage contract, likewise in the adjective norm there is mutual divorce, that is, consensual divorce, and it can be requested before a judge or notary public as long as there are no children, otherwise If there are descendants and when it is done before a notary, the pension, alimony, visitation regime and possession must be regulated. To do this, the scientific, analytical and exegetical method will be used to demonstrate that uncaused divorce protects the integrity of those who intend to terminate the marriage contract.
