The objective of this work is to know the foundations and scope of the retroactivity of the criminal law when seeking a reconduction (adaptation) of the criminal type and / or substitution of the penalty, as well as to identify the interpretation criteria used by criminal judges when resolving requests of this nature. For this, a descriptive-empirical study is carried out, since, despite the apparent simplicity of the subject, it is observed in the national jurisprudence that both justice operators and lawyers are unaware of the functionality of both mechanisms whose purpose is to reduce the penalty imposed before a normative modification that puts the convicted person in a better situation.
