El autor asumiendo una postura agnóstica de la pena en el marco de un derecho penal de garantías sostiene que los tipos penales no tutelan ni protegen bienes jurídicos, sino que prohíben algunas conductas particulares que los ofenden, y con esa premisa, se dedica a deslindar la confusión entre el bien jurídico lesionado y el tutelado como parte de las inconsistencias y contradicciones de la dogmática penal, finalmente afirma que la ciencia jurídico penal conforme a su función de contención debe proteger los bienes jurídicos del descontrol del poder punitivo.
